1.1       This website ("the Site") is owned and operated by Training Journal, which is a trading division of Huveaux Plc's Learning Division (company number 04267888) ("we, us, our"). By using this Site, you agree to these terms and conditions of use ("the Terms"). If you do not agree to the Terms, please do not use this Site.

1.2       We reserve the right to alter, suspend or discontinue any aspect of the Site or the content or services available through it. Unless expressly stated, any new features on the Site shall be subject to the Terms.

1.3       We may alter the Terms from time to time and post the new version on the Site, following which that version will apply immediately. You must check the Terms regularly.

OWNERSHIP AND PERMITTED USE

7.1       Access to the Site and the Materials is provided "as is" and without warranties of any kind. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these Terms.

7.2        We do not warrant that the Site and the Materials are free from viruses or other harmful components.

7.3       We do not warrant or make any representations regarding the utility of the Materials on the Site in terms of their correctness, accuracy, reliability or otherwise.

7.4       Whilst we endeavour to keep the Site and the Materials reasonably up-to-date, error and virus free, we do not warrant that this will be the case as much of the Materials are provided by third parties. In particular, if legal opinion or advice is included in the Materials it is your sole responsibility to ensure the accuracy of such opinions or advice.

LIMITATION OF LIABILITY

8.1       Nothing in the Terms shall exclude our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation. The Terms are all subject to this paragraph.

8.2       In no circumstances shall we be liable to you, in contract, tort (including without limitation negligence) and/or breach of statutory duty, or otherwise for any loss of profits, revenue or income (whether actual or potential), loss of business (whether actual or potential), depletion of goodwill, for increased production costs or for any indirect or consequential (including economic) loss of any kind.

8.3       Subject to the purchase of a subscription to Training Journal governed by our Terms and Conditions of Business to Business Sales, our total liability to you, in contract, tort, (including without limitation negligence and/or breach of statutory duty) misrepresentation or otherwise, for any loss or damage which you may suffer by reason of your use of the Site shall be limited to the amount paid by you, to us for your subscription to Training Journal.

TERMINATION

9.1       We may terminate your access to the Site immediately and without notice if in our sole discretion you fail to comply with any of the Terms. If we terminate your use of the Site do not, and do not attempt to, use it again

LAW, JURISDICTION AND GENERAL PROVISIONS

10.1    The Terms shall be governed by and construed in accordance with English law and you and we each irrevocably agree to submit to the exclusive jurisdiction of the English Courts over any claim or matter arising under or in connection with the Terms. The place of performance shall be England and the language of the Site and the Terms is English.

10.2    We have used our reasonable endeavours to ensure that the Site and the Materials comply with English law. However, we make no representations that the Site and Materials are appropriate or available for use in locations outside England or Wales and consequently we shall bear no liability for use outside England or Wales.

10.3    If any provision of the Terms is unlawful, void or unenforceable, then that provision shall be deemed severed from the Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms.

10.4    No failure or delay on our part to exercise any of our rights under the Terms shall operate as a waiver of such rights.

10.5    The headings in these Terms are for convenience only and shall not affect their interpretation.

10.6    The Terms are not intended to confer benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1998 or otherwise.

REFUND POLICY

11.1    Subscriptions are fully refundable within 28 days of receipt of payment on request of cancellation.

11.2   Non- refundable items include: PDF downloads of TJ articles, Enhanced Director Listings, Recruitment Listings, and all other adverts.
