Learning and Development News - Employment Appeal Tribunal classes dyslexia as disability

A Metropolitan police officer, Chief Inspector David Paterson, has won a landmark ruling in which the Employment Appeal Tribunal has recognised him as a disabled person within the meaning of s1 of the 1995 Disabilty Discrimination Act.  Paterson, who claimed he was unfairly disadvantaged against his peers when undertaking promotion examinations because of dyslexia, was diagnosed with the condition in 2004.

An earlier Employment Tribunal had ruled that "that he was not disabled within the meaning of the Disability Discrimination Act 1995 because that was not a normal day-to-day activity".

However, The EAT upheld the appeal, stating that the Tribunal had misdirected itself on the proper approach to the meaning of disability. 

The claim will now be remitted to the Tribunal to be decided on its merits.
